Acceptance of Terms

Welcome to MyTrust.ai. These Terms of Service ("Terms") govern your use of our website, platform, and blockchain-based document storage services.

By accessing or using MyTrust.ai, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

1. Description of Services

MyTrust.ai provides a blockchain-based platform for securely storing and managing important documents, including:

Last Wills & Testaments

Secure storage of your last will with cryptographic verification and family access controls.

Trust Documents

Storage and management of living trusts with beneficiary access controls.

Medical Directives

Healthcare proxies, advance directives, and medical power of attorney documents.

Power of Attorney

Financial and medical power of attorney documents with verifiable authenticity.

Our platform uses the Ethereum blockchain for cryptographic verification and IPFS for decentralized file storage.

2. User Account

2.1 Account Registration

You must create an account to use our services. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

2.2 Account Information

You agree to provide accurate, complete, and up-to-date information when registering for an account. You must notify us promptly of any changes to your account information.

2.3 Account Termination

We reserve the right to suspend or terminate your account for violations of these Terms, suspicious activity, or at our discretion. Upon account termination, we will retain your data for the retention periods specified in our Privacy Policy.

2.4 Payment Information

You are responsible for all charges associated with your account. Payment information is processed securely by Stripe. You authorize us to charge your payment method for subscription fees and any other applicable charges.

3. Blockchain and IPFS Information

3.1 Blockchain Nature

Documents are stored on a combination of IPFS (InterPlanetary File System) and verified via Ethereum blockchain hashes. Understanding this technology is important before using our services.

3.2 Hash-Only Storage

Only cryptographic hashes (digital fingerprints) of your documents are stored on the Ethereum blockchain. The actual document content is stored on IPFS. The hash proves the document existed and has not been altered, but does not reveal the document content.

3.3 IPFS Storage

Your documents are stored on IPFS for fast retrieval. IPFS is a decentralized storage system. While we control the pinning of your documents, IPFS is not entirely under our control.

3.4 Document Retrieval

Authorized users can retrieve documents through our interface. We recommend not relying solely on the IPFS link for document access.

3.5 Verification

Users can verify document authenticity by comparing the displayed hash with the hash recorded on the Ethereum blockchain using a third-party blockchain explorer.

4. User Responsibilities

4.1 Legal Documents

You represent and warrant that any documents you upload are: (a) genuine and authentic, (b) legally valid and enforceable, (c) properly executed and notarized if required, and (d) not stolen or unlawfully obtained.

4.2 Accuracy of Content

You are responsible for the accuracy, completeness, and legality of all documents you upload. You understand that uploaded documents may have significant legal consequences.

4.3 Account Security

You must keep your login credentials secure and not share them with anyone. You are responsible for all activities that occur under your account, whether authorized or not.

4.4 Prohibited Uses

You shall not use our platform to: upload fraudulent documents, engage in illegal activities, harass or harm others, upload malware, interfere with our services, or violate any applicable laws.

4.5 Not Legal Advice

MyTrust.ai does not provide legal advice. Upload documents prepared by qualified legal professionals or consult an attorney for important documents. We recommend using a trusted estate planning attorney.

5. Pricing and Payment

5.1 Subscription Fees

Our standard subscription is $99 per year for unlimited document storage. Prices are subject to change with notice. Payment is required for account activation and continued access to stored documents.

5.2 Gas Fees

Ethereum network gas fees may apply when recording hashes on the blockchain. These fees are paid in ETH and are not included in our subscription fee.

5.3 Late Payments

If payment is not received within 30 days of the due date, your account may be suspended and documents may become inaccessible until payment is received.

5.4 Refunds

Refunds are generally not provided except in cases of our error or if required by law. Once documents are stored on the blockchain, they cannot be removed even if cancelled.

6. Intellectual Property

6.1 Our Intellectual Property

MyTrust.ai and its content (excluding User Content), including the platform design, graphics, logos, source code, software, and documentation, are owned by or licensed to us and are protected by copyright, trademark, and other laws.

6.2 Your Content

You retain ownership of the documents you upload. By uploading documents, you grant us a limited, non-exclusive, worldwide, royalty-free license to store, manage, and display them as part of our services.

6.3 Blockchain Records

The hash records on the Ethereum blockchain are part of public blockchain data. We do not claim ownership of the blockchain itself or the hash records once submitted.

7. Limitation of Liability

TO THE EXTENT PERMITTED BY LAW, MYTRUST.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR OUR SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE LAST 12 MONTHS.

WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION OF OUR SERVICES. THE PLATFORM IS PROVIDED "AS IS" WITHOUT ANY WARRANTY OF ANY KIND.

8. Blockchain Disclaimer

8.1 Not Legal Record

The Ethereum blockchain is a public ledger, not a court of law or government registry. A hash record on the blockchain does not constitute a legal record in any jurisdiction.

8.2 Verification Required

Users must verify document authenticity through proper legal channels. We recommend obtaining legal opinion letters or affidavits of authenticity from your attorney.

8.3 Network Risks

Blockchain usage involves risks including network congestion, fee fluctuations, and potential platform outages. We are not responsible for any consequences arising from blockchain network conditions.

8.4 IPFS Considerations

IPFS is a peer-to-peer network. Documents may become inaccessible if not properly pinned. We take reasonable measures to ensure document availability but cannot guarantee permanent access.

9. Indemnification

You agree to indemnify and hold harmless MyTrust.ai, its directors, officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, expenses (including attorneys' fees), and costs arising out of or in any way connected with your use of our services, your content, or your violation of these Terms.

10. Dispute Resolution

10.1 Arbitration

Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. This arbitration provision does not prevent you from seeking injunctive relief in court to protect your account or the platform.

10.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles.

10.3 Class Action Waiver

You waive any right to participate in a class, representative, or private attorney general action in arbitration. Each arbitration will be conducted on an individual basis.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page. Continued use of our services after such modifications constitutes acceptance of the modified Terms.
